Reference Checks

I was looking at the M Lee class on reference checking, and it made me wonder...

Has anyone here ever, first hand, experienced a defamation-type lawsuit stemming from a negative reference check?

Anyone? Bueller?

  • not me -- yet. And I am getting a bit weary of companies not providing reference checks -- how else will we know history. Now, all of a sudden, you must go through websites and pay for information that HR professionals used to provide as part of the job.

Frankly, I don't like it. Any HR person knows how to phrase a reference so that the inquiry provides information without being defamatory.

  • No.

Oregon law protects employers who make good faith reference statements. I think its always wise to check what you have documented and use considered language when giving a negative reference but I have never understood why employers are so reticent to give factual references.
