Jury Duty

I hired a contract employee who gets paid bythe day. She will be out for Jury Dury for a couple of weeks. Is she still entitled to receive any compensation and am I required to hold her position?

Have you checked out the NYS website? [url]http://www.ny.gov/[/url] Check in the business, you'll probably have to do some digging. If you have more than 10 ee's and you pay their wages, then normally you have to pay them $40/day for the first 3 days of duty, after that, the court pays the $40/day.

    I think one way to look at it is, do you want the ee to go before the judge and try to get out of serving because her employer will not pay her and will fire her?

    I did find that an employer who penalizes or discharges an ee summoned for jury duty is subject to criminal contempt of court. NY Jud. Law Sec. 519
