I have dealt with that situation in the past and what I've done is to strictly follow the process and allow the employee the 3 days in which to present valid documentation per the list of acceptable documents on the I-9 form. If they don't, then they've been terminated until they can present the necessary IDs. It's their responsibility to comply with your hiring practices. At times those situations have raised a red flag for me and once they present the IDs, I've verified them with INS and the SSA. Remember that we don't only need to look out for illegal individuals but for identity theft as well. Good luck.
