We have the candidate sign our offer letter, which states employment is contingent on a successful post-offer physical and drug screen. Plus, our application refers to this as well and it must be signed by the applicant. I think this is sufficient...
Our application also states that a drug screen and background check will be done and they sign that. When they come in for an interview, we give them the drug screen packet that they also sign for acknowledging if they are offered employment it is contingnet on the drug screen.
I don't know about KY, but we have a "consent form" in our application that explains they can obtain a copy of our policy and they consent to take drug screen if asked. Insert into the application. E Wart
