We just started using Jobdango to post job openings. I was VERY surprised to see that they ask for citizenship status (choices are other, US citizen, US Permanent Resident, or unspecified), ethnicity (with 9 choices plus other and unspecified) and gender (male, female, unspecified) on their resume screen. You can pull your resume to a job listing and not have to enter all the information if the company has their own job application attached.

My concern: What is our legal liability in having that information as part of their application? Normally we wouldn't solicit it until they have been offered a job and accepted.

Has anyone else ran into this type of situation?

As the employer, do you know if you actually get this information when you get a resume? Perhaps they ask for it for their own records, but do not pass it to you. I'd give them a call and express that concern - it's legitimate, and could really cause problems if someone chose to push it.
