OSHA & video taping while driving

An OSHA inspector appeared on a road construction project and video taped the jobsite without the knowledge of the company or job foremen.
The OSHA inspector later stated that an OSHA inspector, or anyone for that matter, can video tape the road work cause it is a public roadway.
Many more questions come mind, but lets start with the basic. WAS THE OSHA INSPECTOR CORRECT?

Does not have to be a road construction project.....could be any construction project... They will video or take pics, before saying hi and starting the inspection......
