I made sure my employees had their w-2's by January 31. I thought this was a "law" to have all employees their w-2's by this date. For the employees that were no longer with us, I mailed them out. Now my question is - I have an employee that had another job during the year of 2005 and she called her other employer - private owners - and asked about her w-2's from them and they answered they had not mailed them out yet. The other employer is located in Florida and we are in Kentucky. Does this make a difference? What recourse does she have - just to wait? I appreciate your advice and comments. Thanks, D.C.

My recollection is that if the employee has not received an expected W-2 by mid-February they can call the IRS and file a complaint.

Sorry, I know we are right and as Geno writes the individual can call IRS and complain if they have not received it by now.
