Employment litigation statistics

I've been trying to find statistics showing the cost of litigation to employers for 2004 (or even 2003). Preferably by state, but even just national would help.

All I can find are EEOC statistics, which I expect are a drop in the bucket to total costs. I also realize that a lot of costs are never reported.

Can anyone help me find this information? Thanks!
