Pre-Employment Drug Screen Results

Where do these results need to be kept? Medical File? Personnel File? Seperate?

  • KENT: Medical file by "A to Z" and not by individual name is how we do it. It is medical information and must be kept seperate of the personnel file. We used to keep this information in the personnel jacket under the medical section. After HIPAA our instructor advised us to move it to a seperate medical record keeping draw and under the "A to Z" system. Yes, it makes it a little more difficult to retreive. now that is with the exception of our Vehicle Class A Fleet Drivers, there record of drug testing remains in their personnel file in the medical section.

  • It makes no difference. A pre-employment urinalysis, by definition, is not a medical test and, as such, is not subject to the ADA requirement that it be kept separate and apart from the personnel file. It can be kept in the file or separate or shredded or in a shoebox on the lower level. I do, though, always keep positive results in a special file and do not ever trash them.
  • We keep them in a separate medical file. We also place FMLA paperwork, FNOII forms, Dr. notes, etc. in the medical file. These are kept for each ee, separate from the personnel file.
