Is is legal in Nevada to ask the question on the employment application as follows?

Have you ever been arrested or convicted of a crime other that a traffic violation?

  • According to the State of Nevada Personnel Application you can ask if they have been convicted of traffic violations, misdemeanors and/or felonies.

  • I'm in MD but our attorney worded it this way on our application:

    "Have you ever been convicted of a crime (other than minor traffic violations) which has not been expunged, annulled, pardoned, or sealed by a court? Yes _____ No ____ If yes, give date, place of conviction, charge, and disposition of each case.


    Note: A conviction may be relevant, if job related but will not necessarily bar you from employment"
  • [font size="1" color="#FF0000"]LAST EDITED ON 07-29-04 AT 01:19PM (CST)[/font][br][br]In a seminar I attended a couple of weeks ago, the presenter from Rockhurst University, KS discussed this very subject. "What you can and can not ask":

    Arrests: No acceptable questions. Unacceptable, Don't ask in any connotation. Speeding tickets are just that (arrest) until they are judicated, then they become convictions.

    Felony Convictions: Can ask about felony convictions. May disqualify applicant for a job-related reason, and not just because of the conviction itself. Unacceptable: Have you ever been indicted for a crime?

    If you can ask about felony convictions you can ask about any conviction.
