We are a services firm and I have an exempt ee that has over 100 hrs of leave accrued. He is in between jobs for a couple of weeks....can I force him to take some leave now so it gets off the books?
We have policies around the use of leave that basically require EEs to use up all valid leave banks prior to having leave without pay. It sounds like you should consider adding such a policy if you don't already have one. This allows you to treat all EEs in the same manner for similar circumstances.
We have a written policy that allows us to ask an employee to use their PTO during slow periods. Without a written policy showing that the employees know of this policy you are on shaky ground.
