ok to check DMV records without ee release?

I need to find out if release from the ee is necessary before we check DMV (driver)records for our employees that drive as a part of their job.

This is for ee's in Michigan and Georgia.

Our current policy regarding driving does not have a statement regarding how often or when we will check records. In the past, we have had the ee sign off when their DMV records were being checked.

I plan to add a statement in the policy that records will be checked at the discretion of the company - but want to make sure this is okay to do without ee's knowledge of when the records will be requested.

some states require the ee's release or notarized, and the "request for information" form will state that, as is the case in Pennsylvania. we operate in PA, MD and DE and run MVR's twice a year. Otherwise, no you are not required to get the ee's release for driving positions. We do not have a policy regarding this

We have the employee sign a release too. Whether or not it's required, I think it's a good idea.
