Employees used in ad

Marketing plans to run an ad with a photo of staff lined up and offering welcoming smiles. Everyone gave verbal consent and knew about the photo in advance and made sure they looked their best on that day. It would be hard for any of them to argue that they didn't want their picture used. I was just wondering if others require some form of written consent that each employee signs off on. Or does anyone address it as policy?

This is a good question. Interesting. I do know that one time our business agreed to let the drug screen consortium come in and film a full fledged commercial at our plant for their advertising purposes. It's still running today, three years later. They had each of us, that appeared, sign a waiver agreeing that they could use our 'likeness' in the commercial and that no pay was forthcoming. I do think they gave everyone, but me (ha), 25 or 50 dollars though. And it took almost all day long to film enough to get three 45 second commercials.

I would want their signature on a piece of paper saying that you had consent. I've become a bit cynical about "verbal" OK's.

Our local paper highlights a different business one day a week. They usually print a picture of an employee with a little blurb about what they are doing. They have the ee sign a waiver much like Don described. It wouldn't hurt to do in your case, too.

I would ask for a signed waiver from all who participated just in case they have second thoughts once the picture is published.

Ditto the above. We did have an employee change their mind once and it was a real hassle.

We have used employees in recruitment ads, as well as marketing pieces. Each employee must sign a waiver in order toparticipate.
