I have a relatively new ee who has not received his last paycheck from previous ER?

Where do I direct him?

I would direct him back to his former ER to ask them why he hasn't been paid. If they don't help him I'd tell him to go to the Labor Commissioner to file a wage claim.

He has already confronted previous ER who was very unhappy he quit and that is why he hasn't paid him.

The employee can download the form from this site and either mail it or bring it in person to file the claim.

The penalty for not paying on time is one day's pay for each day late, so the employee stands to get a little extra.

INELSEN: Is the ee absolutely sure he has not received his last pay check? Almost all new employees I hire they ask "an do you hold back a week of pay"? I go through the whole routine of work and paycheck day; there is no "hold back" it is a matter of working in x week and being allowed sufficient time to get time in, calculate a whole company worth of payments, writing out the check, and getting the check to them before the deadline the following pay day of the next pay week. After I take a time card and explain the whole system to them they say OH! Make sure the ee is really not hung up on the wrong information. Just a thought!

That's a good point, Pork. It seems I've been getting that question a lot lately. It baffles me.

It's like they think we hold back a week's pay as insurance so they'll keep working. Sorry that week's pay was a non-refundable deposit if you don't give proper notice.
