Return from Military Leave

I have an employee that will be returning from military duty in Iraq after 14 months of service. She was employed with us for 4 months. Is she entitled to accrued vacation benefits when she returns? We allow full-time employees 5 days after 6 months of service and 10 days after 1 year of employment.

  • Yes. She is to be reemployed and treated as if she had never left on military leave. So if your vacation leave is based upon months of service (as opposed to hours actually worked), she would be entitled to the accrued vacation.
