checking driving record, is it legal

We need to hire someone that will be required to do fairly extensive driving and at some times will be transporting people for work purposes in their cars. May we request a copy of their driving record prior to hire and may we request the record for our current employees in this job position?

  • Check your state laws (and of course your policies-make sure the potential ee knows you'll be checking his background)....PA permits the review of criminal and driving history for any job-related issues. You may be able to set up a service with your state police to provide you with this information. It may be more reliable (and cheaper) than some of the third party outfits.


  • In Maryland we do! Plus, every six months we check the records again. Most of our employees use "company" vehicles often. Before you check the records of your current employees, add it to your policy. Part of your policy should require employees who travel for business and/or use a company vehicle must report violations and points to the company.

    Experience speaking, once again. An employee, with a suspended license, had an accident with one of our trucks.

    Spare yourself the insurance agony.
  • Also, remember if you outsource for this information it falls under the Fair Credit Reporting Act and you must have them sign a release and a disclosure.
