Isn't it common for employers to have the policy that requires employees to work their scheduled hours the day before and after a holiday to be eligible for holiday pay...or did I miss the memo that said such a policy is no longer legal?? Thanks much.

We also have a policy stating the ee must be employed with us for 30 days prior to the holiday to be paid for the holiday.

If we didn't have that policy, our employees would be home on the reservation or gone to visit family and friends in Illinois.
The concept is we are running a business and although there is a holiday, we need to be able to count on our employees to meet our commitments to our customers.
When an employee is on FMLA leave, don't we have to pay for the holiday? As leave "should not result in the loss of any benefit," and receiving holiday pay is a benefit. I've always interpreted it that way.
Re: FMLA and not paying holidays, I'm not sure. I know that some things are affected by FMLA and some aren't. Attendance bonus can't be penalized, but a production bonus can be. Also, an employee on an unpaid FMLA is not accruing vacation or sick leave, so that is losing a benefit.
