[font size="1" color="#FF0000"]LAST EDITED ON 11-18-03 AT 02:37PM (CST)[/font][br][br]I have an employee who had a heart attack -he had not worked long enough to be covered by FMLA. At the time of his illiness we were very slow in the location he worked in. This was three months ago - he was due to come back to work today - he came by the location and said the Dr. said he would not be released for another month. Over the last month things at this location have picked up and we need that position filled. Is there anything I should be aware of before I tell him we cannot hold his job any longer and send him COBRA?

If he doesn't qualigy for FMLA and if you've followed your published leave policies and haven't treated him any differently than others similarly situated, it seems to be the only thing you can do. You aren't obligated to hold the job open for his return unless your policy requires you to. COBRA him and tell him he can feel free to apply in the future.

No it doesn't and had we not been slow we would have had to replace him immediately. Thanks!
