Our receptionist ( temporary employee)asked yesterday if it was ok that she record her ex-husband calling her here as evidence.She told her supervior that she will buy her own personal pocket recorder to record with and it has no effect upon the telephone system. An officer gave her that information last night. All she need is one incident. The employee is having domestic problems.
My first reaction is No. I don't want the company in the middle of this battle.
I don't think her status as a temp makes a difference but I thought I should mention that fact.

What you have is an employee being harassed at work and a potential for a violent encounter at work. If recording these harassing phone calls will allow her to obtain a Temporary Restraining Order (TRO), I believe the employer must take all reasonable steps to protect the employee, temporary or not.

That's the sound of the truck backing up here.
Where did the DV come into this? Johana only said the person was having "domestic problems". That could mean a whole lotta things: financial, custody, fighting over who gets this, that, etc.
The question you (Johana) asked was should you let her record a conversation. First of all, AZ is a one-consent state so she would be legally permitted to do this. BUT - I don't think it's appropriate for her to do this while on your company time. If he's going to call her at work, he will also call her at home, and that's where the recording should take place.
