Exempt and Non Exempt in MINNESOTA

I have tried and tried to get a simple defination of exempt and non exempt and still don't fully understand it enough to explain it. We are a small company in Minnesota and I need to know the simple defination of the two. We have an employee who does technical work, photography and PowerPoint. I assumed it was ok for him to be considered exempt. Help please.

Unfortunately, you may have to keep trying as exempt status is a hot issue with no crystal clear legal definition. In fact, the DOL has just proposed a new set of regulations to try and clarify the requirements. It sounds to me like your employee may fall into one of the rarely-used exceptions for creative fields. Log on to [url]www.dol.gov[/url] and see if any of that information helps you.
