UI Hearing: What to do

A former ee filed a claim with us. He was let go for job abandonment. So I filled out the er response accordingly attaching our attendance policy along with it. I sent it off well with in the required ten day limit. For some reason, our trusty US postal service lost the response. So, the KDHR thinks we didn't reply. Luckily, I save a copy of what I send so I had the response to fax when I received notice our account would be charged. The only way for our account not to be charged is to go through the appeals process. I received the hearing documents today in the mail. There are some inconsistencies in the man's story. I guess my question is do I need to be prepared to defend our actions as to the termination, or can I just let the judge know we did respond, it just go lost in the mail? I am preparing for the first, but hoping for the second and would like your all's opinons!
