Drug-Testing

A company is creating Policies and Procedures & wants to put in place a drug/alcohol testing if someone is believed to be under the influence or a car accident happens, etc. My question is, can they get a release signed by employee releasing employer & others (i.e. lab) for liability & as a "pre-consent" - it indicates as a condition of employment they agree to get drug-tested if believed to be under the influence & as a condition of employment? Or should they only be signed if an incident occurs?

  • We have employee go through training during orientation as well as sign a consent form when they get pre-employment tested which includes the following statements:

    I understand that there is a random testing program in place and that I may be tested at any time and as many times as the randomization process chooses me. I consent to the collection of all such specimen and testing of all such specimens when and where required.

    I understand that I may be tested for reasonable suspicion if there are valid indications (as specified in the drug plan) of the possibility that I may be under the influence of prohibited substances noted above and/or alcohol.
