Jury Duty

We are located in New York State. We have an hourly employee who served on Jury Duty for 4 days. Monday through Thursday. Her normal work week is Monday through Friday. She then work on Friday and came in on Saturday to work some extra hours. She worked a total of 12 hours and 45 minutes for the company in that week. Her manager feels she should be paid overtime for the 4 hours and 45 minutes she worked extra on Saturday even though she only worked a day and a half for the company. She was paid $40.00 per day for three of the days she served by the company the fourth should be picked up by the courts. My final question is should I have paid her overtime for her hours worked on Saturday?

  • Wage and hour laws only require overtime to be paid for hours worked over 40. Based on that, you would not be required to pay overtime because the time spent on jury duty was not work time, even though you paid her for it. Check your state laws to see if they differ from the federal. My understanding is that if the state law is a "better benefit" than the federal, the state law would prevail.
