what are the pros and cons of implenting video surveillance in the work place. Is it legal?

  • Video Surveillance is generally not illegal under Federal Law (your state may have some specific laws about it -- and you need to check that). But, it has several cons (1) the company can be liable for an invasion of privacy if the video is set up in an area where the employees have a reasonable expectation of privacy (for example a break room); (2) morale can take a nose dive if the employees think "big brother is watching"; (3) if you have a union, you will probably have to bargain with them on the videos; (4) audio taping conversations is generally illegal, so you need to make sure that the video's cannot tape conversations.

    On the plus side (1) having a clearly visiable video camera (like they have in gas stations) can deter crime, (2) It is good evidence if a crime occurs.

    Most employers that uses video cameras use them only in areas where there is a high probability that items might be stolen (for example, exits, entrances and loading docks). Usually they are clearly visible and the employer might even put up a warning sign about the camera, which will help to deter crime.

    The bottom line is that any video camera needs to be driven by a legitimate business interest, and if theft is occuring, it should not be your only means of investigation.
