Overtime

Is there any limit to the number of hours of overtime a non-exempt employee is permitted to work?
Is there a threshold where the compensation goes from time and a half to double time?

  • Regardless of hours of OT an employee work, it must be compensated at the rate of time and one-half. In my agency, the supervisor must approve all OT before worked. If an OT is not approved but worked, it will be paid at the rate of time and one-half. However, disciplinary action will follow for failure to follow agency set policy.


  • Some states have additional limits on hours worked (I know California has some tough state overtime laws). These may include a requirement for specific rest periods, or double time after a certain amount of hours. (Texas has no additional limits).

    Under the federal law, you can't work anyone more than 24 hours a day (even though employers have been known to try).
