Mandatory Overtime

In the state of Georgia, can you require mandatory overtime for a short period of time, to complete projects by due dates. Excluding minors of course. Any feedback would be appreciated.

  • Oops, one more thing! If you can require mandatory overtime, can an employer issue discipline for those employees who refuse to work the overtime or just leaves the work site at their regularly scheduled time?
  • Overtime requirements are covered by the federal law known as the Fair Labor Standards Act. That law has no restrictions on requiring employees to work overtime, except that the employer must pay any employee time and one half that employee's regular rate for all hours worked over 40 in the work week. Georgia has no law saying an employer cannot require employees to work overtiem. Union contracts, however, sometimes provide restrictions on working overtime, so that could apply. Also, employer/employee relations issues should be considered. How will the employees react to the mandatory overtime? Is the mandatory overtime assigned equitably? Is the mandatory overtime due to the company's poor planning.
  • Thanks for your response, I know about FLSA, but was not sure at the state level. We are not union, so that is not an issue and we plan to give advance notice, to alleviate negative employee moral.
