We have an employee who married and they signed a prenup allowing them to keep their respective sole & seperate property - not acquiring community property in the marriage, now or in the future. Her designated beneficiary on her life insurance is not her husband. Will he need to sign a spousal consent?

I believe on life insurance you can name anyone. However, if you have a pension plan, the spouse must agree, in writing, if they are not the beneficiary.

Pension plans can be tapped in the event of a divorce, whereas a life insurance policy will go to whomever is named as the beneficiary. And yes, the spouse must agree in writing, if they are not named as the beneficiary in a pension plan. Our plan requires the spousal waiver to be notarized.
