Sec.125 Divorce notification

We have an ee who just received the final judgment of Dissolution of Marriage signed by the judge on 2/10/05. Can we use this date and paperwork for the sec. 125 eligibility date and allow the ee to enroll in our health/dental plan? There are other dates involved 8/20/04 and 11/5/04. This 2/10/05 is the final judgment of dissolution.

What is the significance (if any) of 8/20/04 and 11/05/04?
What do your insurance contracts say?

Actually, there is an additional date. On 7/13/04 the final hearing went before the court. on 8/20/04 the court entered a Bifurcated Final Judement of Dissolution of Marriage, reserving jurisdiction to determine issues of primary residence of children and ond 11/5/04 court ruled on the remaining issues of pension, alimony and the distribution of assets and liabilities. Then on 2/10/05, the judge signed the final judgment of dissolution of marriage. A qualifying event is divorce. So I am considering the 2/10/05 the final divorce date which says the ee can enroll within 30 days of that date. dp

You would use the final date of dissolution of marriage as the qualifying event. That is the date of record.

What does your insurance policy say. Many policies do not cover the spouse if there is a legal separation. Therefore, when the Bifurcated Dissolutionof Marriage was issued, were the couple legally separated (under Florida Law)?

Florida law does not recognize legal separation.
