Anyone have any information as it relates to Surrogate Mother. Employee became pregnant, took her paid leave, FMLA, utilized health care benefits for her pregnancy. Then it was discovered that this person had been the surrogate for a couple, was paid 25,000 for the service. Seems to me that there should be some recourse. Thankfully it is not my employee, however, one never knows when it could be.

Only in the great state of CA.
All benefits should still be available to her even though she no longer has custody of the infant.
Although with this knowledge she may not need the full 12 weeks allotted to bond with infant.
