PTO and Overtime

What are the common practices used regarding paying OT when PTO, paid holidays or compassionate leave is used? Do you consider them hours worked therefore overtime rules may apply? Thanks

Where I currently work, paid time off is not considered hours worked, hence one must actually work 40 hours before OT would kick in. At my former place of employment it was part of the CBA. ."Paid leave though not actually time worked shall count as time worked for the purpose of computing overtime." So, it can go either way. Don't know which is more common, but am sure others will jump in.

At my previous employer who had a PTO policy, PTO time was not considered time worked when determining overtime but holiday and bereavement leave were.

Holidays, bereavement and vacation is counted towards hours worked. Personal/sick days are not. Because vacation must be scheduled 2 weeks in advance, the OT policy is not abused.

All scheduled PTO counts towards OT. We don't have paid holidays. You have to use your PTO to have a holiday off (we are a medical center, 24/7). Bereavement is considered scheduled time off. Although, bereavement pay is not rolled into our PTO, we allow three days of bereavement and if you need more than that you will have to use PTO.

We base OT on hours worked only - PTO, holiday, bereavement, jury duty, etc. are not counted towards the OT calculation.
