Result of Sneeze a Claim?

This is my first post, although I use the forum frequently for review and entertainment. I am an HR professional/officer of a consulting firm in Pennsylvania. An EE sneezed at work, on the job, and the result was two buldging discs in his neck (verified by an MRI this morning). Workers' Comp?

I doubt it because the employee was not injured as a result of employment. I would have the employee file it with his insurance carrier and let them decide.

Absolutely not! I would like to know, did this person actually fill out a first report of injury on this one?

No he didn't. He called me after his MRI and knowing that he would not be able to work near term, wanted to know what his options were. I told him I would review it and call him back on Monday.

File the claim with wc carrier. It is their job to make the decision.

Although I agree it will not be approved, any accident or injury suffered at work should be filed as a comp claim. Perhaps the employee will say that the air seemed filled with dust that morning or that the ceiling tiles were dusting his desk with those slivers of whatever it is, or the pest control guy had just walked through spraying chemicals. I maintain that is is never the employer's responsibility to decide what is or is not going to be comp approved.

Don's right AGAIN. File the paperwork since it happened on the job and let the WC carrier sort it out. Part of what you pay them for.

Although it appears, as presented, it is not a WC case, it is prudent to do the paperwork for anything that occurs on the work site. A denial would satisfy that a claim was filed. As others have correctly stated, it is the duty of the insurance company(s) to accept / deny.
