How do I know if FMLA?

This may have been previously discussed if so, I am sorry and if you could direct me to the thread it would be appreciated.

I have an ee who has been having alot of doctors appts. he has provided the dr. slips to excuse him for the day. He has informed me that he is having migraines and the doctors have not diagnosed him yet. They are still doing testing.

I have provided him with the FML paperwork and doctors certification forms approximately 3weeks ago. The ee informed me prior to getting paperwork that he might need surgury but I have not heard or received anything back yet. He is constantly off of work for dr appts.

My question is should I be putting these days as FMLA leave or wait to get the paperwork back?

I think you should notify the EE that effective immediately, these episodes are considered FML qualified. Then start the clock. The longer you wait, the longer it will be before the 12 weeks runs.

You might want to inform him that you are "conditionally" considering this as FMLA - in writing. He has 15 days to provide information and he should be informed of this as well. Just a thought.
