FMLA Rules

We have several employees on FMLA but there is one that is chronically out. Can we request that a Dr. not be given every time they are out and require a 30 day advance notice of Dr. appointments or would we be overstepping the FMLA laws?

  • If this person is already approved for intermittent FMLA you cannot request doctor excuses for every absence. You can request advanced notice of doctor appointments but I would caution on putting a set number of days on that notice. Some appointments aren't even made that far in advance. You should just tell the employee that you would appreciate if he could make a reasonable effort to schedule appointments for non-business hours and if he cannot, you would appreciate notice as soon as the employee knows of such appointments. That's about all you can do. Make sure any stipulations you put on this employee are the same as every other employee.
  • Sounds like this person will use up their alloted 12 weeks quickly if they are out a lot. We've had those situations and as soon as they use up the weeks, we usually term, of course after ruling out ADA.x:D
  • We just had a situation like this and as soon as they got close to using up all the weeks, they were miraculously cured! /:)
