Employee reaching one year anniversary

We have an employee who had a baby prior to her one year anniversary and returned to work after 6 weeks, which is according to county policy. Her one year anniversary will be up soon and she will be eligible for leave under the Federal FMLA (she will have been employed for a year and worked enough hours....). Can she now request to take FMLA for the birth of the child? My thinking is that "yes" she can. The original absence is not FMLA because she was not entitled to FMLA at that time.
