FMLA Designation

[font size="1" color="#FF0000"]LAST EDITED ON 06-25-02 AT 12:09PM (CST)[/font][p]We have an employee where we had run FMLA concurrent with a worker's compensation leave in April. The employee returned to work with restrictions later on in April. With on going therapy and treatment, it has since been determined (now June 2002) that the employee has a broken spine as a result of the accident. Her doctor took her off work again. My question is, do I need to re-designate FMLA and send another notice or can I just begin counting the time, since it is for the same injury?

  • Yes, to make it perfectly clear to her and for your records, I'd send her a certified confirmation letter picking back up with FMLA and restating the date on which her eligibility will expire during the period of time your company uses. And giving her a recap of what's already been used in the relevant period. Also stating how pay applies or doesn't apply. Since you're sure the current is closely associated with the former medical situation, in fact is a continuation of it, whatever certification you get from her doctor, I think, will serve the purpose of a backup document for FMLA without having to run her (and the DR) through the entire application process from square one again. Sounds like a serious issue for sure......and you can look for ADA to apply. Looks like one of those three-way-concurrent deals. Happy navigating.
