Does your company purchase EPL insurance? Have you ever been sued and made claim under the policy? What was the "wrongful act"?

Premium keeps going up and never had issues that rose to any level..so interested in feed-back.

We too carry EPL and only have had to use it once after an employee had filed a frivolous discrimination complaint and received their right to sue letter from the EEOC. Legal costs to get a summary judgment was over $33k and was projected to be over $l00k if it went to trial. We carry $5k deductible so the $28k we saved will pay the premium for a few more years. Like any insurance you need to ask yourself can we afford not to have it.

We carry EPL but have not used or needed it. It is just a safety net just in case. The rates are very reasonable you should shop around.

The issue is that defense costs even when there may be no liability can take down a business. If you have 20 or more employees you should seriously be looking as this protection. One importatn factor to compare is whether the defense costs are inside or outside of the liability limits.
