Holding Final Checks

Can any of you send me a link to the law that dictates that an employer cannot hold an employee's final check until uniforms, badges, etc are turned in?

Even if your state laws prohibit you from "withholding" a paycheck, you can still tell employees that they can "pick up their final check from HR when they drop off their keys and uniforms."

If you have them sign something at the time of hire stating that they understand that they will not receive final check until all company property is turned in...you will be covered. I went through this and the DOL told me to do that and it has worked in Texas.

I have been through this in TX. I spoke to the DOL and they told me to have them sign something at the time of hire, stating that they understand that they will not get final check until all company property is returned. It has worked for me. If you don't have anything in writing...the DOL will force you to hand it over.
