I was wondering, when a employee fills out and accident/incident report, and then says they do not care for medical care. Can we still use the report to require a drug test, just to protect ourselves on automatic dismissal because of our company's no drug policy????

Yes, you can. I would recommend total consistency though and I would want to be able to defend the practice by showing that we are not indefensibly selective in who we send and for which incidents.

I agree with Don. We have a written clause that says if the accident injury cost us over $1.00 to get you repaired, then you are subject to providing a urine sample for tested. The refusal to give a sample for testing and/or the positive drug test result are terminating events, without delay.

Even a bandaid cost a $1.00 today.

Consistency is the key. As long as all employees who submit an incident or accident report are required to submit to a drug screening, you are OK.
