You should be retaining the I-9 for 3 years from the date employment begins or 1 year after employment has terminated - whichever is longer.

I respectfully object to the word 'should'. You are neither required to keep the forms longer than that, nor do the regulations suggest you 'should' purge your files. I never have. It's too time and labor intensive to purge those minimal files. But, it's your option to have a purging policy. But those are the minimal standards.

NJJEL: On the back of the form in the paragraph titled Photocopying and Retaining Form I-9, you will find you are correct. "Retained for 1 year after the date employment ends, or (3) years after the date of hire, or which ever occurs later".

It is located in the right hand column of words just above the middle of the page.

WOuld like to inject a question on I-9's. Has anyone seen the new updated I-9. I understand acceptable documents from LIST A has changed I know that they have eliminated #2,3, 8, & 9. Does anyone know when new forms will be available? Thanks

According to the U.S. Citizenship and Immigration Services site - the I-9 still in effect is dated 11/21/91. However, there are changes that went into effect September 30, 1997 (to which you refer) that must be followed - even without the change to the form. Here's the link:
