Has anyone figured out how to handle medical FSAs? I am told they are considered self-funded which puts them into the most stringent compliance categories. We have a FSA and it is outsourced. We receive absolutely no PHI and yet, the best I can figure out, we have to go ahead the write an exhaustive policy, provide notifications, train, etc. Is there something I am missing? It is insane.

Domer: I am new to this forum so please excuse the lateness of this question. I was just wondering if you had resolved the issue of HIPAA and FSAs? I'm waiting for a response from our TPA on whether we have to amend our plan for HIPAA, which was just amended for Health Savings Accounts!
We have fewer than 50 participants/eligible employees, so if I'm reading everything correctly, we wouldn't be subject to HIPAA if we were self-administered instead of having a TPA? That does not seem right so hopefully I am not interpreting correctly.

Well my 2cents worth...I am in the middle of drafting a Notice of Privacy Practices for one company I work for and determining requirements (if have to be compliant) for the other two.
Our lawyer told us, a few key points 1. are you a covered entity? 2. Self-funded plans are covered under HIPAA 3.that includes FSA.
I have almost completed our Notice of Privacy Practices to give to each enrolled employee, but I am told we need to draft a Policy or something as well, I guess to put in our employee handbook? Does anyone have a clue here or example?

I have a Non Retaliation Policy that we are placing in our Employee Handbook. If you would like a copy of that please send me your email address. I might add that we fall outside of the compliance of HIPAA but have been advised that the above policy should still be placed in our handbook. We are a Fully Funded Plan but do not accept PHI.
