Wants to Bring Back Eliminated Position.

In December of 2002 our general manager moved an outside sales position at our California location to the midwest. He left the company shortly after that. The new general manager feels that was not a good strategy and wants to leave the midwest position but try again with an outside sales person in California. Are we under any obligation to find and rehire the person who was in that position but did not want to relocate?

I would say you have no "obligation", but it might be worth considering rehiring him. Sounds like the only reason he left your employ in the first place was because he didn't want to relocate - it was not related to any performance issues. Was he getting the job done previously? Was it an amicable parting of the ways?

If he had performance issues previously, then I would not rehire. If he meets the qualifications of the job, then consider him.

There is no obligation, but you should consider the former employee if the employee was a good performer. If the person was a good employee you will save a bunch of money by rehiring.

Marginal performer at best, but not termed for that reason. Just business choice for the position at the time.
